Can I refuse to take a drug test for CPS? What will happen?: Last year, CPS was called on me by my son’s fathers family. They have done this like 4-5 (or more) times. So Last year in June, CPS opened an investigation (not a case). I was interviewed & I drug tested for them & passed & the investigation was closed. I went to court this last Feb. for custody, & the judge had stated that all of my records from CPS have been either inconclusive or unfounded. I now have 50/50, but my ex doesn't see or talk to our 2.5 year old son. Well they recently called CPS on me again. The social worker came to my house & conducted an interview. She told me that she didn't find anything that would arise suspicion, but that her supervisor will want a drug test before closing the investigation. They conduct the drug test at the AP&P dept. at the court house, where they make you pull your pants down to your ankles & they look at your genitals, from like 2 feet away, while you are urinating. I am a rape survivor & do not wish to have my human rights violated, just for them to continue harassing me when I have done nothing wrong. I know that I am able to refuse to take the drug test. But what are the consequences of doing so? Do I have any other options? Thank you
Evelyn’s answer:
You are very articulate. Speak with higher ups (without being rude to the person you are dealing with.)
Ask if there is another way they can be satisfied these endless complaints are not to be taken seriously and ask if you can do a hair follicle test or a mouth swab if necessary.
I would not want another human being inspecting my genitals or watching me urinate. If this is not necessary - it needs to stop.
What should I do when there is a domestic abuse but no evidences?: My husband threatens me verbally pretty much every day. He says he'll do bad things to me one day. Sometimes as a punishment for me not doing certain things right (like loading the dishwasher they way he wants it to be loaded) or just for no obvious reason. The problem here is that he does it when no one at home or kids are asleep (we have two boys), so I have no evidences. He also have weird reaction toward different situations and people which scares me a lot, he says inadequate things, makes inadequate comments (quite aggressive), sometimes loses control and hits the wall with his fist, or throws whatever he's holding against the wall. He also doesn't treat kids nicely, which breaks my heart. Thanks god he doesn't beat them, but I'm sure it's just a matter of time. My question is: can I go to the police having no evidences of his aggressiveness? Can I also go to a shelter? What should I do first, go to a shelter and then to police, or vice versa? I work but still quite dependent on him (because of children), but I am ready to leave him and begin to work more if needed. Thank you.
Evelyn’s answer:
Start with a simple search for domestic violence hotlines in your area. I just looked - there are several and some are open today - memorial day.
You have nothing to report to the police - you say so yourself .
Can i get in trouble for violating restraining order if i go visit my sons dad in jail? : He made a restraining order against me 2 years ago, but he is homeless and i have been trying to help him and now hes in jail.
Evelyn’s answer:
If you violate a restraining order - you can be arrested.
There will be a clear record of your jail visit.
Speak with an attorney and bring the restraining order with you for some legal counsel.
I have switched this to criminal law as I do not see any child abuse information
